New Swiss Anti-Money Laundering Act (AMLA) and Notarial Practice

In a recent legal analysis, notaries Francesco Naef and Gilles Benedick examined the new Anti-Money Laundering Act (AMLA) and highlighted a significant discrepancy between the three language versions of the law, concluding that the German wording (“reine Beurkundung”) best reflects the intent of the law. The new AMLA does not apply to the celebration of public notarial acts and to the legal advice strictly necessary for their preparation, while independent and accessory advisory activities remain subject to the AMLA.
